Shallow Dive (“we,” “us,” or “our”) operates the website shallowdiveband.com (the “Site”) under Peace Grenade Records (managed by Pitch Perfect Promotions Limited). This Site provides visitors with information about our band, access to our music / images / artworks ("Content"), and the ability to purchase our albums and digital downloads. By accessing or using this Site, you agree to the following Terms of Use.

 

A. Accepting Terms

  1. Using this Site means that you are accessing it through any means (Internet, VPN, mobile network, Wireless Access Protocol, or otherwise), regardless of whether you purchase products, download Content, or interact with the communication features (blog, email).

 

B. Ownership of Content

  1. All music, lyrics, recordings, artwork, photographs, videos, text, and other Content displayed on this Site are the intellectual property of Shallow Dive and our licensors, unless otherwise stated.
  2. You may not copy, reproduce, distribute, modify, display, or create derivative works from any Content without our prior written permission.
  3. Purchasing a digital download or physical item (e.g., vinyl albums) grants you a personal, non-commercial license to listen to or view the purchased work. It does not grant ownership of the underlying copyrights or permission to use our artwork, band photos, or recordings for other purposes.

 

C. Purchases and Downloads

  1. When you purchase an item from our Site: Physical products (e.g., vinyl albums) are shipped to the address you provide during checkout.
  2. Digital products (e.g. WAV, png) are made available for download after purchase.
  3. All sales are final unless required by applicable consumer law. Please ensure your email and shipping information are correct before completing your purchase.
  4. Bandzoogle handles the checkout process and payment collection. Your payment information is processed securely through Bandzoogle’s approved payment processors (Stripe, Paypal).

 

D. Use of the Site

  1. By using this site, you agree not to: Use this Site or its Content for any unlawful or commercial purpose without authorization from Shallow Dive.
  2. Also prohibited: Attempt to copy, reverse engineer, redistribute any digital files provided through this Site, upload or transmit any harmful code, or attempt to interfere with the Site’s operation.
  3. We reserve the right to restrict or terminate your access to the Site if these Terms are violated.

 

E. Intellectual Property Rights

  1. All Content, copyrights, trademarks, and other intellectual property rights appearing on this Site belong to Shallow Dive and our respective owner Peace Grenade Records (under Pitch Perfect Promotions Limited).
  2. The band name, logos, album art, and associated images are protected and may not be used to promote or represent any other person, product, or service.


F. Privacy

  1. Our privacy practices are governed by our Privacy Policy, which explains how we collect and use your information through the Bandzoogle platform.

 

H. Disclaimer of Warranties and Liability

  1. This Site and its Content are provided “as is.” We make no guarantees that the Site will be error-free or continuously available. We are not responsible for any loss resulting from your use of the Site or from any delays or interruptions in service.
  2. To the fullest extent permitted by law, Shallow Dive and its members shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products.
